Lawsuit Filed Over Courthouse Fall and Unsafe Conditions

November 6, 2025

The Law Office of Jason Ingber has filed a lawsuit in Los Angeles County Superior Court on behalf of a visitor who suffered serious injuries due to unsafe conditions inside a government courthouse. The complaint alleges that the courthouse operator failed to properly maintain an inoperable escalator and lighting system, creating a hazardous environment that caused a severe fall and lasting injuries.

Incident and Dangerous Conditions

According to the complaint, the incident occurred on September 13, 2024, at the Stanley Mosk Courthouse in downtown Los Angeles. The plaintiff was lawfully present to attend proceedings when she attempted to use an escalator inside the building.

Unbeknownst to visitors, the escalator was completely inoperative, functioning as a stationary stairway without any warning signs, barriers, or caution tape. Compounding the danger, the overhead lighting was broken, leaving the area dimly lit and obscuring visibility.

As she descended, she tripped over an uneven bottom step, which was higher than standard height due to the escalator’s mechanical failure. The combination of the inoperable escalator, poor lighting, and lack of warnings directly led to her fall.

Severe and Lasting Injuries

The plaintiff was transported to Cedars-Sinai Medical Center immediately following the incident, where diagnostic imaging confirmed a displaced fracture of the left foot’s navicular bone.

She underwent extensive treatment, including:

  • Emergency care and orthopedic evaluation,

  • Fifty-eight sessions of physical therapy spanning seven months, and

  • Ongoing medical monitoring due to persistent pain and reduced ankle mobility.

The injuries resulted in a significant loss of income as she was unable to work for several months and continues to experience limitations in mobility and daily function.

Allegations Against the Courthouse Operator

The lawsuit asserts that the defendants had prior notice of the dangerous conditions and failed to take reasonable measures to protect the public. Specific allegations include:

  • Failure to maintain the escalator in safe working condition,

  • Failure to repair or replace the broken lighting,

  • Failure to warn visitors of the hazard, and

  • Neglecting inspection and maintenance duties mandated under California law.

The complaint emphasizes that the courthouse’s mandatory public access—for court appearances, jury service, and legal proceedings—creates a heightened duty of care for visitor safety.

Damages and Relief Sought

The lawsuit seeks:

  • General damages for pain, suffering, and emotional distress,

  • Special damages for past and future medical costs and lost earnings, and

  • Other compensation permitted by law, with total damages exceeding $5 million.

The plaintiff also seeks a jury trial to determine the extent of the defendants’ liability for negligence and premises liability.

Holding Public Entities Accountable

This case underscores the importance of public safety and maintenance accountability in government-operated facilities. Courthouses, where attendance is often mandatory, must ensure that visitors are protected from foreseeable hazards.
